IT WAS an open-and-shut case of one motorist ploughing head-on into another at a red traffic light, but after realising he was captured by his dashcam singing at the time, the victim in this case has conceded and refused to hand over the footage.

“I’d rather fork out the €270,000 for my medical expenses,” crash victim Martin Phelan told the court, before swallowing the mini SD card from his dashcam in front of stunned onlookers.

Rushing to his defence, Phelan’s solicitor explained that the 34-year-old father-of-five had been attempting to sing the Travis version of Britney Spears’ ‘Baby One More Tim’ when he was struck by Tim Mareeugh’s car, who was later seen on CCTV using his phone and veering across the road minutes before the incident.

“No judge, not a hope I’m putting the court through that moment,” Phelan interrupted, struggling to drink water as the plastic card worked its way down his oesophagus. “Especially when the car hit me just as I tried to reach the really high, whiny bit. Just think James Corden doing Carpool Karaoke times 100. It’s not something anyone here deserves.”

Acknowledging the gesture and taking into account the song’s notoriously unforgiving vocal range, Judge William Barry accepted the decision.

“This happens all the time, Mr Phelan,” the judge said. “Only last week we had to sit through a best man’s speech. I thank you for the courtesy and will award you half your medical costs and urge everyone here to be more careful and not to sing and drive.”
